1. Acceptance of Terms

By accessing the website thefxworld.com, communicating with our team, or executing a Statement of Work (SOW), Service Agreement, or project invoice, you acknowledge and agree to be legally bound by these Terms of Service. If you do not agree to all terms, you must discontinue use of our site and services immediately.

2. Scope of Services

FX World provides bespoke creative and marketing services, including but not limited to:

• Fintech & brand influencer marketing, creator matchmaking, and campaign execution.
• Cinematic 3D animation, VFX, motion design, and video post-production.
• Brand architecture, visual identity, graphic design, and positioning.
• High-performance web development, digital product landing pages, and interactive UI engineering.

Individual deliverables, production timelines, revision allowances, and fees are defined in specific client Statements of Work (SOW).

3. Financial Disclaimers & Audience Due Diligence

To protect both our company and our clients, the following guidelines are strictly enforced:

• Informational & Educational Only: All videos, social media posts, visual representations, and articles produced for clients or creators are created exclusively for informational, educational, and creative storytelling purposes.
• No Guarantees of Financial Return: FX World makes no representation or warranty regarding the performance, profit, financial return, or market outcome of any client product, platform, or investment vehicle.
• Client Regulatory Responsibility: Advertisers and brands partnering with FX World bear full responsibility for ensuring their offerings comply with regulatory guidelines (including SEBI, RBI, ASCI influencer guidelines, and local consumer laws).

4. Independent Creator Network

Creators, market mentors, and influencers featured or coordinated through our agency operate as independent contractors. Unless explicitly written in a dedicated tripartite agreement, creators do not represent the legal voice of FX World, and FX World does not control personal opinions expressed outside the scope of contracted campaigns.

5. Intellectual Property Rights

Our intellectual property provisions ensure clear ownership and security:

• Agency IP: Pre-existing frameworks, design systems, algorithms, proprietary templates, and internal tools developed by FX World remain the exclusive intellectual property of FX World.
• Client Deliverables: Upon full and final settlement of all agreed project invoices, final approved creative deliverables are licensed or assigned to the client as specified in their contract.
• Portfolio Rights: FX World retains the non-exclusive right to showcase completed creative work, video clips, and designs in our public portfolio, awards submissions, and case studies unless restricted by an active NDA.

6. Limitation of Liability

To the fullest extent permitted by applicable law:

• FX World, its founders, directors, employees, and partners shall NOT be liable for any indirect, incidental, punitive, consequential, or special damages, including lost profits, business interruption, loss of data, loss of goodwill, or trading losses.
• In no event shall FX World's cumulative aggregate liability arising from or related to any project exceed the total fees actually paid to FX World by the client during the three (3) months immediately preceding the claim.

7. Client Indemnification

You agree to defend, indemnify, and hold harmless FX World and its personnel from any third-party claims, legal disputes, damages, fines, regulatory penalties, or legal fees arising from: (a) your breach of these Terms, (b) the illegality or regulatory non-compliance of your products or services, or (c) any defamatory, misleading, or infringing content provided by you to FX World for campaign use.

8. Governing Law & Jurisdiction

These Terms of Service and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding shall be subject to the exclusive jurisdiction of the competent courts located in Indore, Madhya Pradesh, India.
